Court seizes documents of Poltava region’s HQC due to record of ‘unfit’ for service in AFU

The investigating judge of the Oktyabrsky District Court of Poltava has seized the documents of the district military medical commissions (MMCs) of Poltava region. The basis for this decision was a study by the National Agency for the Prevention of Corruption (NAPC) and an investigation by the Poltava Oblast Police, "Komersant Ukrainian" reports
The NAPC noted that the largest rate (20%) of those who passed the VLC and were subsequently found unfit to serve in the Armed Forces of Ukraine was found in Poltava region.
“Poltava region is one of the five regions with the highest number of people declared partially fit – 31% of the total number of those who passed the commission in 2022 and 30% in the first nine months of 2023,”
– the report says.
According to the investigation, employees of the regional military enlistment commission, when declaring people partially fit and unfit for military service, allegedly received undue remuneration for their illegal actions.
The pre-trial investigation is ongoing, establishing the existence of false information in the medical records of persons liable for military service, falsified grounds for applying the articles of the schedule of diseases and physical disabilities that determine the degree of fitness for military service and exclusion from military registration.
It should be noted that the Cabinet of Ministers has established that during mobilisation or martial law, the validity of the conclusion of the military medical commission on fitness is one year. In peacetime, such a conclusion is valid for five years.
on 4 May, regulations amending the Regulation on Military Medical Examination in the Armed Forces of Ukraine came into force. The key change is that the status of “partially fit” is cancelled, and only “fit” and “unfit” remain.
Among other things, Ukraine has changed the procedure for appealing against the decisions of the MEC – a second military medical commission will be held in another institution.
It should be noted that the updated law on mobilisation came into force on 18 May. All men aged 18-60 must update their registration details within 60 days – until 16 July inclusive.
The Ministry of Defence launched the mobile application “Reserve” for persons liable for military service, conscripts and reservists on 18 May, after the updated law on mobilisation came into force.
