Rada proposes to take away prosecutors’ disability superpensions: details of the bill

Current legislation on disability pensions

Ukrainian legislation defines the right to a disability pension through the compulsory pension insurance system. The pension depends on the disability group and the insurance period of 1 to 15 years:

  • Group I receives 100% of the old-age pension,
  • Group II – 90%,
  • Group III – 50%.

At the same time, special pension conditions apply to prosecutors, military personnel and victims of the Chernobyl disaster.

According to Article 86(9) of the Law “On the Public Prosecutor’s Office”, prosecutors with disabilities of groups I or II are entitled to a pension of 60% of their monthly salary, provided they have worked for at least 10 years. This calculation is significantly higher than the standard payments for other categories of pensioners.

According to the Pension Fund, as of 1 October 2024, there were 10,342,593 registered pensioners in Ukraine, of which 15% (1,559,748 people) receive a disability pension. The average disability pension in Ukraine is UAH 4,892.57, while individual prosecutors can currently receive up to UAH 60,000 of such pension per month.

What the draft law proposes to change

The document provides for the cancellation of the right of prosecutors with disabilities of groups I or II to receive a special pension of 60% of their monthly salary. Instead, it is proposed that the conditions of pensions for prosecutors should be equated to mandatory standards.

The document also provides for a new version of Article 50(1) of the Law “On Compulsory State Pension Insurance”, which clarifies the rules for the return of pension amounts paid due to abuse. Excessive payments caused by falsification of documents, unjustified decisions on disability or submission of inaccurate data may be returned voluntarily or recovered by the territorial bodies of the Pension Fund or through the courts.
