In June, the L.E.A.D. Foundation was launched in Ukraine. Its activities are aimed at rethinking the role of justice at a time when Ukrainian society is experiencing unprecedented challenges – war, loss, displacement, and uncertainty.
The Foundation puts people, not systems, at the center of change. Its approach is based on the idea of trauma-sensitive justice – justice that does not deepen or ignore trauma, but supports the recovery of the individual. Instead of harsh sentences, rehabilitation programs are used. Instead of stigmatization, rehabilitation and reintegration.
This is a new philosophy that has already shown its effectiveness in countries with similar experience, particularly for veterans, victims of violence, people with addictions, and young people.
“In times of profound social transformation, justice must also change,” believes Ksenia Tkachuk, the founder of the Foundation. “The old methods no longer work. We need approaches that provide an understanding of what psychological trauma is. Approaches that respect human dignity. And which can restore trust – in the state, in the system, in each other.
The Foundation explicitly declares a departure from the Soviet model of punitive justice, focused on statistics of those punished for the sake of reporting. Instead of mechanical prosecution, L.I.I.D. advocates for targeted assistance to veterans and people in crisis, and for finding the deeper causes of offenses, such as PTSD, aggression, violence, addictions, and other psychological disorders.
The L.I.I.D. Foundation has already started working with judges, prosecutors, lawyers, and rehabilitation services. Its goal is to help Ukrainian institutions move toward a modern, evidence-based, ethically sound approach to justice.
The Foundation’s approach is based on four principles:
- People are at the center of change.
- Innovations – new, therapeutic and restorative approaches to justice for the defendant.
- Institutions – supporting the transition to trauma-informed justice.
- Trust – restoring the connection between people and the state.
Trauma-sensitive justice is not a fashionable innovation or a compromise. It is a demand of the times. It is a path to justice that does not punish for pain but heals it.
