Ukraine legalizes the right of parents with children to work remotely

295 deputies supported amendments to the Labor Code of Ukraine to improve the legal regulation of certain issues of home and remote work.” The adoption of the relevant law No. 10164-1 is reported on the parliament’s website, "Komersant Ukrainian" reports.
The deputies focused on the well-known situation when a general secondary education institution is forced to operate a mixed form of education, i.e., full-time and distance learning, but this creates difficulties for parents of children if they work at the same time as their child is studying remotely.
The deputies resolved this situation by supplementing the Labor Code of Ukraine with provisions on the possibility (in agreement with the employer) of transferring one of the parents to a home-based or remote form of work in the case of a child under the age of 14 studying remotely.
The law also regulates the issue of sending home-based and remote workers on business trips. Due to a gap in the legal regulation of this issue, home and remote workers and their employers had problems with regulatory authorities, when registering business trips, calculating and paying compensation.
It has been determined that the conditions for sending a remote worker on a business trip are determined by the remote work employment agreement.
What is the difference between remote and home-based work?
According to the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine on Improving the Legal Regulation of Remote, Home Work and Work with Flexible Working Hours” (No. 1213-IX), two independent forms of work organization were introduced: remote and home work.
Remote workers can work anywhere they choose. At the same time, they must be in touch with the employer using information and communication technologies.
A home-based worker performs work at the place of residence or in other places designated by him/her outside the employer’s premises. Such work is characterized by a fixed work area or technical means, for example, tools, accessories for the production of products, provision of services or other work. A home-based worker is “tied” to the address specified in the employment contract and can change it only with the employer’s permission.
A home-based worker usually follows the general working hours of the company. Whereas the rules of internal labor regulations do not apply to a remote worker. They distribute their working hours at their own discretion.
By the way, the demand for remote work has long been high, as has the competition for “remote” positions.
For example, every six months, experts from the Work.ua portal state that competition for remote work is 5 times higher than the market average. But in January this year, competition for remote work broke all records and increased by 49% compared to December.
