Deferment for teachers and researchers: how to apply correctly

Ukraine has changed the procedure for granting a deferral from mobilization for researchers, academics and teachers. Lawyer Daria Tarasenko explained who exactly the innovations concern, how to apply for a deferment, and why it is not enough to submit documents once, "Komersant Ukrainian" reports

What has changed in the legislation: new version of the CMU Resolution

on May 30, 2025, the Cabinet of Ministers of Ukraine adopted Resolution No. 633, which amended Resolution No. 560. In particular, paragraph 25 of clause 60, which regulates the procedure for granting deferred action for scientific, pedagogical and research and teaching staff, was set out in a new wording.

The new wording reads as follows:

“The postponement of a call-up for military service during mobilization, for a special period, is granted to persons specified in subparagraph 2 of paragraph 2 of Annex 5 for a period of one year, but not more than for the period of mobilization established by a decree of the President of Ukraine, or the occurrence of circumstances under which a person loses the legal grounds for postponement. In case of prolongation of the mobilization period established by a decree of the President of Ukraine, in order to prolong the postponement of a call-up for military service during mobilization for a special period, persons liable for military service referred to in this paragraph shall, not earlier than one week before the end of the previous mobilization period established by a decree of the President of Ukraine, submit to district (city) territorial recruitment and social support centres (separate departments) a certificate on the position held at their main place of work and the amount of time

The previous version of this paragraph read as follows:

“The postponement of a call-up for military service during mobilization and for a special period for persons specified in subparagraph 2 of paragraph 2 of Annex 5 is granted until the end of the academic year, but not more than until the circumstances under which the person loses the legal grounds for postponement.”

Who can get a deferment from mobilization

The deferment applies to research and teaching staff of higher and pre-higher education institutions, scientific institutions, as well as teachers of vocational and general education schools.

“The deferral can be granted to researchers, research and teaching staff who work at their main place of employment,” explains lawyer Daria Tarasenko.

“But the procedure for its registration is now clearly regulated and has become stricter in terms of timing and updating documents.

What is the period of deferral now?

The deferral will be valid for the period of mobilization established by the President, or until the person loses the right to deferment.

“From now on, such a deferral is granted for a period of one year, but not more than for the period of general mobilization determined by a decree of the President of Ukraine,” the lawyer notes.

Do I have to submit something again?

“The first time you have to submit a full package of documents, including an application for a deferment, then every 3 months you will need to submit to the TCC and JV an up-to-date certificate of your position at the main place of work and the amount of the share of the rate of pay (the same as with the initial application, but “fresh”),” Tarasenko emphasizes.

Failure to do so will result in the deferral lapsing.

When to submit the certificate

The certificate must be submitted no earlier than one week before the end of the pre-determined mobilization period, but it is possible to submit it later.

For example, if the Presidential Decree sets a deadline of August 6, 2025, then the updated certificate can be submitted as early as July 31, 2025, the lawyer clarifies.

How and where to apply for a deferral

The documents should be submitted to the district (city) TCC and JV.

“I think it’s also possible to send a certificate by mail,” adds Daria Tarasenko, “but be sure to include a cover letter explaining why the document is being submitted.”

The lawyer provided an official sample application, which is recommended to be submitted together with a “fresh” certificate of the position held and the share of the rate in the TCC and JV. Such a statement will help to clearly explain the purpose of submitting the documents and avoid confusion during the extension of the deferral period.
