MPs want to introduce new penalties for traffic violations: details

Drivers who consistently run yellow traffic lights will be deprived of their license for up to one year. This is stated in the bill No. 12172, which was submitted to the Verkhovna Rada on November 1, "Komersant Ukrainian" reports.

The bill was initiated by MPs Oleksandr Horeniuk, Serhiy Ionushas, Maksym Pavliuk, Serhiy Minko, Olena Vintoniak, Yevhen Bragar, Oleksandr Horobets, and Oleh Kolev.

The group of MPs justifies the need for their bill by saying that Ukraine has underdeveloped tools of so-called “special deterrence,” i.e., influencing the behavior of repeat offenders (recidivists) who are not deterred by the threat of one-time fines.

“Therefore, the need to revise the administrative and tort approach to the commission of systematic deliberate administrative offenses in the field of road safety by a person is an urgent issue,” the text of the draft law says.

The authors of the document propose to supplement Article 122 of the Code of Ukraine on Administrative Offenses with new parts that will determine administrative liability for

  • repeated violation of pedestrian crossings;
  • failure to give way to pedestrians on unregulated pedestrian crossings;
  • driving through a prohibitive traffic signal or gesture of a traffic controller;
  • violation of the rules for passing intersections, violation of the rules for overtaking and oncoming traffic.

The following penalties are provided for their commission

  • for repeated violations within a year after the imposition of a fine for such violations, a new fine of 60 non-taxable minimum incomes (UAH 1,020 – ed.) is imposed;
  • if the violation was committed by a person who has been subjected to an administrative penalty for any of the listed offenses twice within a year, a fine of 150 non-taxable minimum incomes (UAH 2,550 – ed.) is imposed. In addition, a person is deprived of the right to drive a vehicle for a period of six months to one year.

The MPs who registered this draft law in the Verkhovna Rada assure that its adoption will help reduce the number of administrative offenses related to gross and systematic violations of traffic rules, and, as a result, will reduce the number of deaths and injuries on the roads in the future.

According to the official data of the Patrol Police Department, in 2023, 3,053 people died in road accidents in government-controlled territory of Ukraine, and another 29,502 people suffered injuries of varying severity. Speeding was the most common violation that led to road accidents, and was officially identified as the cause of 56% of all road deaths
on the roads. The death rate per 1 million population in Ukraine is 97, while the average among the 27 EU members as of 2022 was 46 deaths per 1 million population, with the leading countries having rates in the range of 30.1 Neighboring Poland has a rate of 50 deaths per 1 million population.
