Court finally closes the case against Patskan – the statute of limitations has expired

The Appeals Chamber of the High Anti-Corruption Court (HACC) has considered the defense’s motion to release the former MP from criminal liability and close the criminal proceedings due to the expiration of the statute of limitations. This was reported by the HACC press service, without mentioning his name, "Komersant Ukrainian" reports
According to the Anti-Corruption Action Center (AntAC), the case concerns former MP Valeriy Patskan, who was accused of illegally receiving UAH 127,400 in compensation for housing.
According to the court, the petition was filed as part of the consideration of the parties’ appeals against the HACC verdict of 09.10.2023. According to the verdict, the former MP was found guilty of abuse of office under Part 1 of Article 364 of the Criminal Code of Ukraine (CCU), but was released from punishment due to the expiration of the statute of limitations.
“Based on the results of the consideration, the panel of judges dismissed the prosecutor’s appeal, granted the defense’s motion for release from criminal liability, and therefore canceled the HACC verdict,” the High Anti-Corruption Court said in a statement.
The Appeals Chamber, based on paragraph 3 of Part 1 of Article 49 of the Criminal Code, released the accused from criminal liability for committing a criminal offense under Part 1 of Article 364 of the Criminal Code due to the expiration of the statute of limitations.
It is noted that the ruling comes into force from the moment of its announcement and may be appealed in cassation directly to the Criminal Court of Cassation of the Supreme Court within three months from the date of its issuance.
The Patskan case
In April 2023, Patskan was dismissed from the position of the Chairman of the Accounting Chamber.
In October 2023, the HACC found Patskan guilty of illegally receiving compensation for housing, but released him from punishment due to the expiration of the statute of limitations.
According to the court’s decision, Patskan had to reimburse UAH 127.4 thousand of the housing compensation he received and pay UAH 7.85 thousand for expert examinations. The court also upheld the bail of UAH 49.62 thousand.
In April 2024, the Appeals Chamber of the High Anti-Corruption Court found the former Chairman of the Accounting Chamber Valeriy Patskan not guilty in the case of receiving compensation for housing.
However, according to the AntAC, the SAPO prosecutor disagreed with the decision and filed a complaint with the Supreme Court, which partially upheld it and sent the case for a new hearing to the HACC Appeals Chamber.
