10 banks received comments from the Antimonopoly Committee on cashback

The Antimonopoly Committee of Ukraine (AMCU) has issued mandatory recommendations to ten leading banks in the country to avoid possible violations of unfair competition. These are loyalty programs such as cashback, which are actively used to encourage customers. This is reported by the press service of the AMCU, "Komersant Ukrainian" informs
The Committee emphasized that banks should clearly and fully inform consumers about the terms, restrictions and exceptions to participation in cashback programs.
Why the problem arose
Currently, bank cashback has become one of the most common tools to encourage consumers to use the services of a particular bank, which has its own cashback programs that operate both on a regular basis and as part of temporary marketing campaigns.
Consumers learn about the availability of cashback offers, in particular, from notifications in a mobile application, advertisements on official websites, social media, etc. The Committee has identified cases where such notifications may not contain, in particular, complete and/or accurate information on the terms, conditions, restrictions and exclusions for participation in these loyalty programs.
The absence of clear information in such notifications about the terms, conditions, restrictions or exclusions of participation in cashback programs may mislead consumers, which may result in the consumer not receiving it.
To whom the recommendations are addressed
Ten banks received the recommendations:

- “Credit Agricole Bank
- “Pivdenny Bank
- “FUIB”
- “Raiffeisen Bank
- “Sense Bank”
- “Universal Bank
- “Industrialbank”
- “MTB Bank”
What the AMCU requires:
- to indicate complete and truthful information about cashback in messages;
- in case of a large amount of data, add QR codes or hyperlinks to the full terms and conditions;
- clearly explain in which stores and for which services customers can receive rewards.
In addition, due to the growing demand for cash on delivery, banks should indicate in the section on restrictions on participation in cashback programs that cash on delivery payments are not eligible for cashback (if any).
Why it is necessary
The AMCU emphasizes that transparency of information will ensure fair competition in the market and allow customers to make informed decisions.
Banks are required to respond to the recommendations within 30 days.
