kolomoisky is trying to challenge the nationalization of Privatbank in the Supreme and Constitutional Courts

on February 26, the Administrative Court of Cassation of the Supreme Court will consider Ihor Kolomoisky’s complaint against the Cabinet of Ministers, the National Bank, the Ministry of Finance, the Deposit Guarantee Fund and PrivatBank to challenge its nationalization (case No. 826/7432/17).

This was reported by the bank’s press service, "Komersant Ukrainian" reports.

Kolomoisky is challenging the nationalization in both administrative and commercial courts. The consideration of the commercial case ended on November 26, 2024.

Then the Commercial Court of Cassation of the Supreme Court finally confirmed the impossibility of returning the state-owned PrivatBank to its former owners and closed the proceedings on the claim of Kolomoisky and Triantal Investments LTD.

Yesterday it became known that Kolomoisky appealed to the Constitutional Court to declare unconstitutional certain provisions of Law No. 590-IX, which he considers “anti-Kolomoisky.”

He argues that these provisions make it impossible to recover property rights, limit judicial protection, and violate the principle of equality of parties in litigation. The businessman asks to declare them unconstitutional, as he believes they allegedly contradict a number of articles of the Constitution.

So far, the CCU has refused to open proceedings against the former owner of PrivatBank. However, this decision was not made unanimously by the panel of judges, so the Second Senate of the CCU will finally decide on the issue of opening the proceedings.

Also yesterday, the Administrative Court of Cassation scheduled the hearing of the administrative case for today, February 26. This administrative case has been under consideration since 2017. In April 2019, the now-liquidated Kyiv District Administrative Court ruled in favor of Kolomoisky and declared the nationalization illegal, despite the explicit prohibition on depriving the state of ownership of PrivatBank shares.

After a lengthy appellate review of the case, it was only in November 2023 that the Sixth Administrative Court of Appeal granted the petition of PrivatBank, the National Bank, the Cabinet of Ministers, the Deposit Guarantee Fund, and the Ministry of Finance and closed the proceedings, overturning the illegal court decision to satisfy Kolomoisky’s claim.
