Pharmacies will be forced to change their names: Pecherskyi District Court has ruled in favor of Oschadbank

The Pechersky District Court of Kyiv has issued a ruling prohibiting the “Oschad Apteka” pharmacy chain from using the name “Oschad.” This follows a lawsuit filed by Oschadbank and has a significant impact on the pharmacy chain’s operations.

This was reported by Oschadbank’s press service, according to "Komersant Ukrainian".

The court granted Oschadbank’s key requests, which sought to prohibit the use of the “Oschad” designation in the sale of pharmaceutical products. The ban applies to pharmacy signage, advertising, business documentation, and online information. The court also invalidated the trademarks for “Oschad Apteka.”

The Court’s Rationale

The court’s decision notes that as of January 1, 2017, the designation “Oschad” had become well known in Ukraine as being associated with Oschadbank and its financial and banking services. This factor was one of the grounds for granting the claim filed by Oschadbank.

The “Oschad Apteka” chain is part of the larger “Podorozhnik” pharmacy chain. A ban on the use of the name “Oschad” could affect their brand identity and communication with customers.

The court’s decision was issued in the first instance and is not final. This means it can be challenged by filing an appeal. The defendants have the opportunity to continue the legal proceedings to try to overturn the decision.
