Criminal case and home searches: Lawyer warns of the consequences of ignoring “summonses”

In Ukraine, there is a rule under which a summons can be considered served even without the recipient’s personal signature. Lawyer Serhiy Kasyanchuk stated this in an interview with the YouTube channel "Komersant Ukrainian".

“Currently, a summons is considered served as soon as it is sent—regardless of whether the person received it or not. It’s nonsense, but that’s the rule,” he said.

The lawyer advises against ignoring summonses received by mail. This is especially true for so-called mobilization (“combat”) summonses, which are sent to those who have already undergone a medical examination. Failure to appear can result in serious legal consequences, says Kasyanchuk.

“If a person fails to appear in response to such a summons, the TCC forwards the information to the police to initiate criminal proceedings. By the way, this gives them the right to conduct searches at the person’s place of residence,” he said.
