Kyiv’s Central Department Store Tried to Invalidate the Trademark Registration of a Shopping Center in Boryspil: How the Dispute Ended

The Boryspil shopping center “Kyivsky Shlyakh TSUM” has officially defended its trademark rights, according to "Komersant Ukrainian", which cites Bohdan Myronenko, the administrator of a local Facebook community.

Kyiv TSUM attempted to invalidate the trademark registration, arguing that the name was too similar to its own brand and could mislead consumers.

“However, the Appeals Chamber disagreed. The ruling states that ‘TSUM’ is a common abbreviation, while the phrase ‘Kyivsky Shlyakh’ clearly refers to the shopping center in Boryspil, located on the street of the same name,” Mironenko noted.

The panel also found no evidence that the Boryspil TSUM is attempting to pass itself off as the one in the capital or is misleading customers.

As a result, the Kyiv TSUM’s objection was dismissed, and the registration of the “Kyivsky Shlyakh TSUM” trademark remains in effect.
