Court Rejects Former Deputy Prosecutor General Verbytskyi’s Lawsuit Against the NACP: Details

The Kyiv District Administrative Court has dismissed the lawsuit filed by former Deputy Prosecutor General of Ukraine Dmytro Verbytskyi, who sought to overturn the NACP’s conclusion and declare the agency’s actions against him unlawful. The relevant decision has been published in the Unified State Register of Court Decisions, according to "Komersant Ukrainian".
According to the case materials, Verbytsky asked the court to declare the NACP’s conclusion of July 3, 2024, unlawful and to overturn it, as well as to declare the agency’s actions regarding the continuation of monitoring his lifestyle after that date unlawful. However, the court did not grant Verbytsky’s claims.
Thus, the court effectively confirmed the legality of the NACP’s actions in conducting an investigation and preparing a conclusion regarding possible signs of illicit enrichment by the former deputy prosecutor general.
Background
In July 2024, the NACP announced that it had transferred materials regarding Verbytsky to the SAPO to initiate criminal proceedings under Article 368-5 of the Criminal Code of Ukraine (illegal enrichment). According to the agency, the amount in question was approximately 29 million UAH.
Former prosecutor Stanislav Bronevitsky, commenting on the court’s decision, stated that it raises questions for anti-corruption agencies regarding the further investigation.
“In fact, the court confirmed the legality of the NACP’s actions in identifying signs of illicit enrichment. At the same time, no charges have been filed yet, even though nearly two years have passed since the investigation began,” he wrote.
According to him, following the court’s decision, it is unclear why the case has not progressed to the stage of formal notification of suspicion.
“What is the problem with this proceeding? Why, given the NACP’s conclusion and the court’s confirmation of its legality, are there still no formal charges from NABU and the SAPO?” he added.

As of now, there is no public information regarding the issuance of a notice of suspicion to Dmytro Verbytskyi in this case.
Who is Verbytskyi
Dmytro Verbytskyi was dismissed from his position as Deputy Prosecutor General (under Kostin, ed.) amid a scandal. Several journalistic investigations at the time accused the official of illegal enrichment.
Journalists from Radio Liberty, in particular, revealed that Verbytsky owns several properties in the “Konik” cottage community, where the real estate is registered under his nephew’s name and that of Khristina Ilnytska. In addition, journalists discovered that the couple owned a fleet of luxury cars: a Porsche Macan T worth 3.5 million UAH, LEXUS ES 300H (960,000 UAH), LEXUS NX 300H – 480,000 UAH, as well as houses and land plots in Kyiv and Odesa and an apartment with a land plot in Antalya, Turkey, worth 3.9 million UAH.

Additionally, NACP investigators found 2 million UAH in cash and cryptocurrency of unknown origin in Verbytskyi’s possession .
The investigation against him is currently ongoing, but the NABU is not commenting on any details of the probe.
Meanwhile, Verbytskyi has turned to public and political activities, as evidenced by posts on his Facebook page.
