The EU has extended temporary protection for Ukrainians, but there is a new condition

The European Union has officially extended the temporary protection mechanism for Ukrainians for another year. At the same time, the decision includes a new requirement for a specific category of citizens. This was reported by "Komersant Ukrainian", citing the Council of the European Union.
The EU Council has agreed to extend the Temporary Protection Directive for Ukrainian citizens until March 4, 2028.
This mechanism has been in effect since March 2022 and grants Ukrainians the right to:
- reside legally in EU countries;
- work;
- access healthcare services;
- pursue education;
- receive social assistance in accordance with the laws of their host countries.
According to the Council of the EU, more than 4 million Ukrainians have taken advantage of temporary protection since the start of the full-scale war.

What Will Change for Ukrainians Subject to Military Service
The most significant change applies only to new applicants.
According to the EU Council’s decision, temporary protection will not be granted to individuals who cannot confirm that they left Ukraine in accordance with the requirements of Ukrainian legislation regarding military service.
The following may be used as proof:
- a passport with a stamp indicating lawful departure;
- a paper or electronic document confirming the fulfillment of or exemption from military service;
- other documents provided for by Ukrainian law.
Will the new rules affect those already in the EU?
The Council of the EU specifically emphasized that the new restrictions do not apply to Ukrainians who are already under temporary protection.
This means that people who were granted this status earlier retain all their rights without having to re-confirm the legality of their departure from Ukraine.
When will the new rules take effect?
The decision to extend protection will apply from March 5, 2027, to March 4, 2028.
At the same time, the provision requiring new applicants to confirm fulfillment of military service obligations will take effect as soon as the decision enters into force following its official publication.
Why the EU made this decision
The European Commission’s explanatory documents state that the decision is intended to simultaneously:
- ensure continued protection for Ukrainians fleeing the war;
- take into account Ukraine’s defense needs;
- maintain a balance between humanitarian support and respect for Ukrainian legislation regarding military service.
