The State Bureau of Investigation has released new details about a scheme to seize the apartments of deceased individuals, involving former judge Tandir

The State Bureau of Investigations has released new details and testimony in the case involving fraud involving the apartments of deceased individuals in Kyiv and Odesa, where one of the suspects is Oleksiy Tandir, a former judge from Makariv in the Kyiv region. This was reported by the SBI’s press service, according to "Komersant Ukrainian".

The SBI does not directly name the suspect, whom they describe as one of the organizers of the scheme involving the apartments of deceased individuals, but emphasizes that the suspect is a “former judge from the city of Makariv who, in May 2023, struck a soldier at a checkpoint in Kyiv.” Oleksiy Tandir, who served as a judge of the Makariv District Court, is currently on trial in this case.

Case details

Last week, Oleksiy Tandir was charged with participating in a criminal organization linked to the illegal appropriation of apartments belonging to deceased individuals in Kyiv and Odesa.

“As the investigation established, the apartment scheme operated from 2021 to 2023. The perpetrators carefully prepared for the crime, working out the mechanisms for cooperation and execution of their plan. As a result, within a short period of time, they managed to take possession of five apartments in the Odesa and Kyiv communities. They intended to take possession of one more apartment, but in the end, the owners turned out to have an heir, and the criminal intent of the organized criminal group (OCG) was thwarted,” the statement reads.

According to the State Bureau of Investigation (SBI), the group’s main plan was to find an apartment whose owner had died without leaving an heir. The perpetrators would then draw up a fictitious purchase and sale agreement for the property and, through fabricated court rulings, transfer ownership to their trusted associates.

The investigation established that the judge, who was later involved in a traffic accident, his lawyer, and a former state enforcement officer were the masterminds of the group.

“In order for the former judge to issue a formal ruling in the interests of the organized criminal group, two other accomplices filed a civil lawsuit claiming to recover millions in debt for money previously borrowed. However, the borrower settled with the creditor using apartments that had already been seized from their deceased owners,” the statement reads.

The group’s activities were clearly structured and well-organized. According to the investigation, the participants in the scheme:

  • created fictitious debts between controlled entities;
  • filed forged lawsuits in court;
  • obtained judgments to collect non-existent debts;
  • seized apartments through the enforcement service;
  • registered ownership of other people’s property;
  • then sold the apartments to third parties.

According to the State Bureau of Investigation (SBI), a former judge of the Makariv Court issued rulings based on knowingly forged documents and effectively helped legalize the illegal seizure of real estate.

“In fact, a tragic traffic accident at a checkpoint in Kyiv in May 2023 and the subsequent attention of law enforcement on the former judge made it possible to put an end to this cynical scheme of illegally seizing apartments belonging to deceased citizens. The pre-trial investigation is ongoing. No crime should go unpunished,” the SBI reported.

There are currently five suspects in the case. Pre-trial measures have been imposed on all of them. In particular, “the former judge will remain in custody without the option of bail.” The penalty under this article provides for up to 12 years of imprisonment with confiscation of property.
