Risk of Losing Protected Lands: Prosecutor’s Office Appeals Court Ruling on the Hryshko Botanical Garden

The Office of the Prosecutor General has filed an appeal against the decision of the Kyiv Commercial Court, which denied a lawsuit seeking to invalidate an agreement between the M. M. Hryshko National Botanical Garden of the National Academy of Sciences of Ukraine and a private company. This was reported by the Prosecutor General’s Office, according to "Komersant Ukrainian".

“This concerns an agreement concluded in 2018 that provides for the reconstruction of real estate properties on the grounds of the botanical garden. Under its terms, upon completion of the work, most of the renovated properties are to become the property of the private company,” the statement reads.

The prosecutor’s office believes that the implementation of this contract poses a risk of the illegal alienation of state property and the land of the nature reserve fund on which it is located.

The State Audit Service of Ukraine also pointed out violations of the law during the agreement’s conclusion.

In June 2026, the Kyiv Commercial Court denied the claim filed by the Specialized Environmental Prosecutor’s Office, concluding that the disputed agreement did not conflict with the interests of the state and society. The Prosecutor’s Office disagrees with this decision and is seeking to have it overturned on appeal.

“The Specialized Environmental Prosecutor’s Office of the Office of the Prosecutor General will continue to defend the interests of the state in court, ensuring the protection of state property and particularly valuable lands in the nature reserve fund from illegal alienation and development,” the statement reads.

The M. M. Hryshko National Botanical Garden covers nearly 130 hectares of the nature reserve fund and is a monument of landscape architecture of national significance. It is home to the famous Lilac Grove, and its plant collection is one of the largest in Europe. The botanical garden is of exceptional importance for nature conservation, scientific research, and recreation.
