Court upholds revocation of Evrogaz filling station’s license to sell fuel

A court has confirmed the legality of the revocation of Retailplus LLC’s license to retail fuel in Kyiv due to the submission of false documents. This is stated in the register of court decisions of Ukraine, "Komersant Ukrainian" reports.
Details of the litigation
Retailplus LLC (formerly UkrRetailGas LLC) (owner and director – Andriy Kirichenko) filed a lawsuit against the Kyiv City State Tax Service, asking to declare unlawful and cancel the order to revoke the license for retail fuel trade.
The plaintiff argued that the order was issued unreasonably, violated the law, and that the prosecutor’s letter could not serve as a basis for revoking the license. The defendant filed a response stating that it did not agree with the claim. It provided a lease agreement with Deloitte LLC for a 0.04-hectare land plot and documents for non-residential premises.
The prosecutor’s office and the Department of Land Resources of the Kyiv City State Administration conducted a survey of the land plot, finding that the Evrogaz gas station was actually located on a different plot than the leased one. The expert’s opinion confirmed that the gas station and premises were not located on the plot for which the plaintiff had submitted documents for obtaining a license. Accordingly, it was found that the application contained inaccurate data, which was the basis for the license revocation.
What the court decided
The court found that Ukrryteilgaz LLC was registered in 2018, changed its name to Retailplus LLC and its address in 2023. The license was issued on September 11, 2019 for a period until September 16, 2024. The order to revoke it on 20.05.2021 was based on the fact that the company had submitted inaccurate information about the right to use the land plot. The plaintiff’s complaint against the decision to revoke the land plot was dismissed on 22.12.2021.
The court concluded that there were no grounds to appeal the defendant’s order, as the license revocation was legal and justified. The plaintiff submitted incorrect documents regarding the land plot on which the filling station was actually located, and this corresponded to the grounds for revoking the license. The actions of the Main Department of the State Tax Service in Kyiv were recognized as lawful.
