Decisions regarding the terms of plea agreements and the amounts of fines are made by a single individual—the head of the Specialized Anti-Corruption Prosecutor’s Office.

This was stated on the YouTube channel "Komersant Ukrainian" by Stanislav Bronevitsky, a former prosecutor of the Specialized Anti-Corruption Prosecutor’s Office and a lawyer.

“The decision to enter into agreements in a specific criminal proceeding is made by just one person—the head of the SAP. That’s how it actually works. This isn’t written anywhere in the law, but at the same time, that’s how it works in practice,” he noted.

According to Bronevitsky, this applies both to determining the amounts of donations and to selecting the funds to which proceeds from plea agreements will be directed.

“Where, to which fund, and what amount should be transferred—he alone decides. Just one person. Although, according to the law, the initiative to conclude a plea agreement and the subsequent decision on a guilty plea must be agreed upon between the prosecutor and the defense. It is up to the specific prosecutor and the defense to initiate this process, work through it, and make the final decision—depending on the specifics of the criminal proceedings,” he emphasized.
