New Reservation Rules: What Businesses Need to Do by August 10

The Cabinet of Ministers of Ukraine has approved changes that simplify the procedure for confirming the status of critically important enterprises and for re-enlisting employees subject to military service. The new rules will allow companies that meet the updated criteria to automatically confirm their status and extend their current deferments. This was reported by "Komersant Ukrainian", citing Cabinet Resolution No. 862 dated July 1.

How the New Mechanism Will Work

According to the government’s decision, enterprises that retain their status as critical after the review will be able to complete the confirmation process much more quickly.

To do so, they must submit, by August 10, documentation confirming that their average wage has been raised to three times the minimum wage. Currently, this figure stands at 25,940 hryvnias, up from the previous 21,618 hryvnias.

After that, companies will be able to continue retaining employees without having to go through the full procedure again.

All companies must complete the re-registration process by September 1

The resolution also amends Government Document No. 692 of May 30, which requires all companies to re-register in accordance with the updated criteria.

Until this procedure is completed, the “Reserve” app will display September 1 as the expiration date for the reservation.

By that time, the Ministry of Defense of Ukraine and the Ministry of Digital Transformation of Ukraine must ensure electronic interoperability between state registries for the automatic exchange of information regarding:

  • the status of critically important enterprises;
  • established reservation limits;
  • the number of reserved employees;
  • the terms of the deferrals granted.

What other changes has the government introduced?

In addition to simplifying the procedure, the Cabinet of Ministers has adopted a number of other important changes.

Specifically:

  • for employees who hold multiple jobs, the reservation quota will be calculated based only on their primary place of employment, where the employment relationship has been longest;
  • government agencies will gain access through the Diya portal to information about employees subject to military service, reservation limits, and instances where those limits have been exceeded;
  • the restriction that limited the submission of documents via “Diya” to once every five calendar days has been lifted.

Who Is Exempt from the Average Salary Requirement

The government has also expanded the list of enterprises to which the average salary requirement does not apply.

The following are exempt from this requirement:

  • electricity distribution system operators;
  • coal mining and coal processing enterprises;
  • certain enterprises in the energy sector.

In addition, the list of critically important enterprises now includes those that, without using budget funds, develop, modernize, and ensure the operation of the information systems of the Ministry of Defense of Ukraine.

What Enterprises Face

At the same time, the government reminds companies that they may lose their status as critical enterprises—and their employees may lose their right to job protection—if the average salary does not meet the established minimum level of approximately 26,000 hryvnias.
