The Downfall of a Tobacco Monopoly: Court Opens Bankruptcy Proceedings Against “Tedis Ukraine”

The Commercial Court of Odesa Region has opened bankruptcy proceedings against Tedis Ukraine LLC—a company that, just a few years ago, was one of the largest players in Ukraine’s cigarette distribution market. This is reported in the court registry, according to "Komersant Ukrainian"
According to the court ruling, Accord Gold LLC filed a petition to open bankruptcy proceedings due to debt under supply contract No. 31/07-1-2025 dated July 31, 2025.
The amount of the debt is 38,062,088.15 UAH.
Why “Tedis Ukraine” ended up in bankruptcy proceedings
According to court documents, a supply contract was concluded between “Tedis Ukraine” and “Accord Gold.” The buyer was required to make full prepayment for the goods, and the supplier was required to deliver the products in accordance with the orders.
Between August 5 and 19, 2025, “Accord Gold” transferred an advance payment for the goods to “Tedis Ukraine” totaling UAH 57.47 million. Subsequently, a portion of the claim—UAH 19.41 million—was transferred to LLC “FC “Mia Group” under a factoring agreement.
After that, the amount of Accord Gold’s claims against Tedis Ukraine stood at exactly UAH 38.06 million.
The parties also signed an agreement to terminate the supply contract. In it, “Tedis Ukraine” confirmed its financial obligation to “Accord Gold” and was required to return the funds. However, as noted in the court documents, the obligation was not fulfilled, and the money was not returned.
The company acknowledged the debt
It is important to note that “Tedis Ukraine” itself, in its response to the court, acknowledged the existence of the debt to “Accord Gold” in full and did not object to the initiation of bankruptcy proceedings.
In addition, the debtor informed the court of the actual cessation of business operations, a significant amount of outstanding financial obligations, and the lack of sufficient funds to settle them.
What the Court Decided
The Commercial Court of Odesa Region opened bankruptcy proceedings against Tedis Ukraine LLC. The court also recognized Accord Gold’s monetary claims against the company in the amount of:
- 38,062,088.15 UAH in contractual debt;
- UAH 33,280 in court fees.
In addition, the court imposed a moratorium on the satisfaction of creditors’ claims and initiated proceedings for the disposition of the debtor’s assets.
Artem Danilov, an arbitration manager, was appointed as the property administrator. The next hearing in the case is scheduled for June 2, 2026.
What “Tedis Ukraine” was known for
For many years, “Tedis Ukraine” was one of the key players in the Ukrainian tobacco distribution market. In 2023, with revenue of approximately 61.5 billion UAH, the company was among the top ten largest private companies in Ukraine.
However, in 2025, according to YouControl, the company’s revenue dropped to nearly zero.
Forbes Ukraine reported that the key reason for the sharp drop in revenue was the termination of contracts with major tobacco manufacturers, including Philip Morris and JTI Ukraine. Without official distribution agreements, the company lost the foundation of its business.
How the cigarette distribution market has changed
After Tedis Ukraine lost its market position, the cigarette distribution market underwent a transformation. According to YouControl, DL Solution emerged as a new major player, reaching revenues of over 100 billion UAH within a few years.
This indicates a significant shift in the balance of power in a segment where Tedis Ukraine previously held an exceptionally strong position.

Old Issues with the Antimonopoly Committee
The company also had a long history of conflicts with the Antimonopoly Committee of Ukraine. In December 2016, the AMCU found “Tedis Ukraine” guilty of abusing its monopoly position in the cigarette distribution market in 2013–2015 and imposed a fine of 431 million UAH.
While the company paid the fines in installments between 2017 and 2020, it failed to fully comply with additional obligations (ceasing the abuse and submitting monthly reports on cigarette prices and sales volumes).
For this, the AMCU fined the company again—this time 274 million UAH. The company attempted to challenge the fine in court but lost, resulting in a 100% penalty being imposed. Consequently, the company was required to pay 548 million UAH to the state budget.
Does this mean the company will be liquidated?
The initiation of bankruptcy proceedings does not automatically mean the company’s liquidation. This is a legal procedure during which the court, the bankruptcy administrator, and the creditors must determine the debtor’s actual financial condition, the extent of its assets, and the amount of its debts.
At this stage, various scenarios are possible: reorganization, debt restructuring, a settlement agreement with creditors, or, if solvency cannot be restored, a transition to liquidation proceedings.
