Similar to the “Obukhiv” case: The AMCU fined a business owner for the design of the paper

The Antimonopoly Committee of Ukraine has fined a business owner from the Zhytomyr region for using packaging design for his products that resembles the packaging of “Obukhiv 65M” toilet paper. This was reported by the AMCU press service, according to "Komersant Ukrainian".
“The Administrative Board of the Northern Interregional Territorial Branch of the Antimonopoly Committee of Ukraine fined sole proprietor R.V. Radchenko for the unauthorized use of the packaging design for ‘Zhytomyrsky’ products without the permission (consent) from the private joint-stock company ‘Kyiv Cardboard and Paper Mill,’ which had previously begun using similar packaging design for its ‘Obukhiv 65M’ products in its business operations, which could have led to confusion with the activities of that business entity.” – the statement reads.
The Kyiv Cardboard and Paper Mill filed a complaint with the AMCU regarding the competitor’s actions. The Committee noted that sole proprietor R. V. Radchenko used a similar design for the packaging of “Zhytomyrsky” products without the permission of the Kyiv Cardboard and Paper Mill.
“The branch opened a case based on a complaint filed by PJSC ‘Kyiv Cardboard and Paper Plant’ (KKPK), which complained about the competitor’s actions. PJSC “Kyiv Cardboard and Paper Plant” was informed that sole proprietor R. V. Radchenko was using packaging designs for the aforementioned products that were similar to the point of confusion with the packaging designs of products manufactured by PJSC “Kyiv Cardboard and Paper Plant.” However, the complainant did not grant sole proprietor R.V. Radchenko permission to use similar packaging design,” the statement reads.

The Committee concluded that such actions by the sole proprietor “could have led to confusion between the activities of both business entities and provided sole proprietor Radchenko with an unfair competitive advantage through the use of PJSC “KKPK’s” business reputation.”
Thus, the Administrative Panel of the Northern Territorial Division of the AMCU found the sole proprietor’s actions to be a violation of the law on protection against unfair competition and fined him 30,000 UAH.
This likely refers to sole proprietor Ruslan Vasylovych Radchenko, who is registered in Zhytomyr. The entrepreneur’s economic activities include the production of paper products for household, domestic, and sanitary-hygienic purposes.
As a reminder, on March 14, the Kyiv Cardboard and Paper Mill suffered a large-scale missile attack by the enemy. As a result, industrial and administrative buildings, production facilities, and utility infrastructure were damaged.
Another attack on the plant took place on April 3. Following that attack, the plant was forced to temporarily halt production.
