Military personnel cannot get land plots: what the StateGeoCadastre says

The problem of obtaining land plots by military personnel in Ukraine is gaining increasing attention. Despite the fact that military personnel have the right to receive land plots, in reality they often face various obstacles.

In particular, the amendments to the legislation that came into force on 19 November 2022 prohibit the free transfer of land.
“This provision of the law stipulates that it is prohibited to transfer state-owned and municipally owned land into private ownership free of charge, to grant permits for the development of land management documentation for the purpose of such free transfer and to develop such documentation. The provisions of this sub-clause do not apply to the free transfer of land plots to private ownership,” said Natalia Chernenko, Head of the Main Department of the StateGeoCadastre of Kyiv and the Region.
The only exceptions are cases when the land plot is already in use or when real estate is located on it, Chernenko added.
Thus, the possibility of free transfer of state or municipally owned land to private ownership is significantly limited by law.
Obstacles to obtaining land

She says that back in 2019, the court ordered the StateGeoCadastre to reconsider the application for permission to develop documentation for land allocation. However, there is still no response. The cases of 116 soldiers are up in the air because of local “princes”.
As for the case of Serhiy Polishchuk, whose request for a land plot in Boryspil district of Kyiv region was illegally blocked, the Kyiv District Administrative Court ruled that the actions of the StateGeoCadastre were unlawful.
“One of the main obstacles is the actions of Dmytro Yakovlev, who appropriated 16.24 hectares of land in the same area after the death of his father. Yakovlev has no legal right to use this land, let alone lease or sell it, as it is state property. This case is part of a conspiracy that has been going on for years, and the son is simply using the influence of his late father,” the human rights activist said.
Thus, the situation with the free transfer of land to the military remains complicated.
